Attorneys Michelle Garcia Gilbert and Amy McGrotty have launched a new law firm specializing in the areas of mortgage default, loss mitigation, real estate litigation, evictions, bankruptcy, and REO closings
throughout the state of Florida.
According to the firm’s partners, the Gilbert McGrotty Group was established to provide lenders and the loan servicing and default professionals that support them with a comprehensive solution to the myriad of legal needs stemming from non-payment of secured mortgage loans in Florida – a state whose homeowner delinquency rate continues to climb.
Gilbert and McGrotty explained that a borrower’s decision to not pay a debt triggers a series of critical, inter-related, time-sensitive legal responses requiring immediate attention from professionals with different areas of expertise, including: litigating the foreclosure; handling a bankruptcy; driving occupant evictions; reviewing and tightening resale and purchase contract to eliminate buyer contingencies; teaming seamlessly with the REO title insurer to guarantee rapid closings; and removal of properties from the lender’s books.
The two attorney say that for years, they have been hearing just how time consuming it can be for already over-worked lenders and their servicing partners to coordinate multiple providers for the necessary legal services, while also overseeing payment histories, default dates and notices, payoff amounts, and the like. With the Gilbert McGrotty Group, they say the result is a “fast-laned” foreclosure-to-resale process, employing the information technology case management systems which provide noticeable client cost savings.
The firm partners bring a combined forty years of real estate and creditor rights legal expertise to their business.
Gilbert will lead the new firm’s Tampa office. She has worked in foreclosure and creditors firms since 1989, and handles a wide variety of legal matters, including judicial foreclosures, evictions, workouts and forbearance agreements, deficiency actions, bankruptcy, collection matters, and related litigation. She is admitted to practice throughout the state of Florida and in a number of Florida District Courts, as well as the U.S. Supreme Court and U.S. Court of Appeals. Gilbert received her Juris Doctor from the University of Notre Dame.
McGrotty is head of the firm’s Fort Lauderdale office. She has practiced law since 1989, when she began working in the areas of real estate and bankruptcy litigation. Her current practice focuses on residential and commercial real estate closings, title insurance, foreclosure litigation, loss mitigation, creditor workouts, and representation of creditor rights in bankruptcy throughout the state of Florida. McGrotty also serves as a local counsel for numerous out-of-state law firms requiring representation in Florida. She is a cum laude graduate of Nova University Center for the study of law.
